"Beware of talk in social media or you will be imprisoned"
Victims Act Information and Electronic Transactions (ITE) continue to fall. Southeast Asian Freedom of Expression Network (SafeNet) noted that until now has been more than 70 people who are victims of this policy.
Regional Coordinator SafeNet Damar Juniarto say, Ervani Emihandayani (29) were victims of the 72nd. According Damar, housewife from Bantul, Yogyakarta go to jail just because Heartline on Facebook.
Despite the suspension of detention granted, Ervani still have to stand trial in court. He is charged with Article 27, paragraph UU ITE.
Damar accused, this article is a legal loophole that could be used rulers and public officials to silence criticism of society. As a result, each year the number of victims of this Act continues to climb.
In a note SafeNet, from January to November 2014, more than 40 people were charged under this law. In fact, since enacted until 2013, this law is only targeting one to two people in a month.
"We see not as matter of ethics, but there are loopholes in the Act ITE used to imprison anyone else," said Damar.
Researchers from the Institute for Policy Research and Advocacy (Elsam), Wahyudi Djafar, said similar things. He said, article 27 paragraph 3 of Law ITE as a tool of revenge. Therefore, people are so easy to report other people and people who reported directly to jail.
He explained that, in its application, "loopholes" is often problematic, because very little reference material.
Yudi judge, UU ITE troubled and flawed, because the Ministry of Communications and Information Technology does not provide technical guidance to police and prosecutors. As a result, the executor of the law can interpret Article 27, paragraph 3 as their understanding.
